Can Congress require remote retailers to pay taxes to states that the states would not be able to impose without violating the due process clause of the Fourteenth Amendment? One federal district court believes it can, while another district court and the U.S. Court of Appeals for the Second Circuit believe that it cannot. The U.S. Court of Appeals for the D.C. Circuit is set to hear this issue later this year.
