Until recently, an Ohio lawyer who secretly recorded his conversations with other lawyers or witnesses violated the ethics of his or her profession. Early this summer, the ethics board of the Ohio Supreme Court reversed its long standing position when it announced that ?A surreptitious, or secret, recording of a conversation by an Ohio lawyer is not a per se violation of the [Ohio ethical ban on dishonest conduct], if the recording does not violate the law of the jurisdiction in which the recording took place.? Opinion 2012-1.
