The Supreme Court recently decided a case on Indian contracting the presents Congress with a number of choices as to how it will respond. In the Indian Self-Determination and Education Assistance Act
(ISDEAA) and related appropriations, Congress has given the Department of the Interior two mandates that are impossible to fulfill simultaneously.
