When Kiobel v. Royal Dutch Petroleum Co. first reached the Supreme Court, the question presented was relatively simple: can corporations be sued under the Alien Tort Statute (ATS) for human rights violations? In a plot twist worthy of a John Grisham legal thriller, the high court upped the stakes by asking the parties to file supplemental briefs on whether U.S. federal courts can entertain any lawsuit by foreign plaintiffs against foreign defendants for acts committed on foreign soil.
