Do arrestees have diminished privacy rights as it pertains to compulsory DNA collection? The U.S. Supreme Court seems poised to answer this question. Recently, Chief Justice Roberts issued a temporary stay on a Maryland Court of Appeals decision which issued an injunction and found the state?s DNA Collection Act unconstitutional as it pertains to individuals arrested but not yet convicted of a crime.
