In its landmark health care decision issued on June 28, National Federation of Independent Business v. Sebelius, the Court held that the individual mandate was a constitutional exercise of Congress? taxing power. In so doing, the Court found that the relevant statutory provision, Section 5000A of the Internal Revenue Code, was a tax, emphasizing three key points.
